Kennedys Environment Team has been providing specialist advice on environmental cases to a variety of industry clients as well as insurers for over 20 years.
Environmental Disputes can threaten a company’s reputation on a national and local level, undermine value and incur significant management time. The more serious breaches of environmental law can lead not only to enforcement action under numerous statutory provisions, but also to criminal prosecution of individual directors, managers and companies. Much of our work involves complex issues and we are very experienced in handling sensitive issues of public interest and corporate strategy.
Our experience includes
- Contaminated land and water pollution – we have experience of litigation and commercial settlement of oil pollution cases arising out of transport accidents and also the long-term leaching of contamination from premises
- Noise claims - we deal on a regular basis with noise abatement notices arising from industrial and similar activities
- Statutory nuisances – we have wide experience of dealing with and appealing against all forms of statutory nuisance arising from the use and state of premises
- Common law nuisance – we regularly act on a range of common law nuisance claims
- Appeals against “regeneration notices” under s.215 of the Town and Country Planning Act 1990
- Prosecutions – we have defended a number of prosecutions including those arising out of the contamination of controlled waters
